Recent media reports have mentioned a lawsuit involving j5create and USB-C hubs. We must clarify that the article (see "reports") contains misleading information and does not accurately reflect the facts of the case. Here are the key points:
1. Hyper’s Utility Patent Declared Invalid
Hyper’s primary claim in its lawsuit against j5create was based on utility patent US 10,572,429 (‘429), which has been ruled invalid by the Patent Trial and Appeal Board (PTAB) of the United States Patent and Trademark Office. This ruling confirms that j5create’s products do not infringe Hyper’s patent and protects other companies in the industry from harassment based on this invalid patent. In the past, Hyper used the ‘429 patent to file lawsuits against multiple companies. PTAB’s ruling is a significant safeguard for the development of the USB Type-C industry.
2. Court Dismissed Hyper’s Design Patent Compensation Claims
Regarding Hyper’s allegations in court of infringement on seven design patents, the court dismissed Hyper’s compensation claims, with the judge ruling that Hyper had attempted to seek excessive damages for design patents in an “act of brazen gamesmanship.” The court did not award Hyper any compensation. Additionally, while the court found for Hyper on a packaging design, this packaging had already been discontinued since mid-2019. As a result, the court did not issue an injunction against any j5create product, meaning there is no impact on j5create’s future business operations. 3. No Trademark Infringement; j5create Products Remain Available for Sale
In the same legal proceeding, all of Hyper’s trademark-related allegations regarding Ultradrive were dismissed by the court. The court also rejected Hyper’s claims of false advertising and unfair competition. j5create products remain fully compliant and available for sale in the market without any restrictions.
4. j5create Achieved Victory in the Majority of Allegations
In this lawsuit, Hyper filed more than 17 allegations, covering utility patents, design patents, trademarks, copyrights, false advertising, and unfair competition. However, the court dismissed the majority of Hyper’s claims, and j5create achieved a significant victory.
